Terms of Business

General

Byrne Consultancy utilises a fixed billing process to reduce unexpected costs for our clients. An estimate for any work requested will be provided, specifying rate and duration of the work.

The estimate will reflect the final amount payable for the work, including VAT, assuming no changes to the work or requirements are made.

Any changes to work or requirements will result in an amended estimate being provided.

Cancellation of any work, excluding software development, will result in a pro-rata charge.

Cancellation of a software development project will incur all charges up to the point of cancellation and may incur a penalty charge.

Contracted Services

Where consultancy services are contracted for a fixed period of time or for the duration of a specific task, the contract between Byrne Consultancy Limited and the client will specify an agreed payment schedule.

Continuous Support

Continuous support of IT systems will be billed monthly on the 1st of each calendar month at the agreed rate.

Ad-Hoc Consultancy and Support

Ad-Hoc consultancy and support will be billed upon completion of the agreed tasks.

 

Software Development

Bespoke software development will always be undertaken under a fixed payment schedule.

A requirements gathering and software design phase will produce an estimated plan for development.

Unless otherwise agreed, development tasks will be billed in three stages. 50% prior to development commencing, 25% upon delivery of the application and 25% upon acceptance of the application by the client.

Bespoke software, and any associated intellectual property rights, will remain the property of Byrne Consultancy Limited until payment of the final stage invoice.

Payment Terms

Unless otherwise specified under contractual terms, payment terms for all invoices will be 14 days from the date of issue. Payment via online banking transfer or BACS is preferred. A charge may be made for payment by cheque.

Overdue invoices will be charged penalty interest at 7% above the Bank of England base rate in force at that time.
